"Online Services" (hereafter: Services) offered by Schoolhouse Fare are provided under an agreement with Subscribing Schools (Schools) for use by their affiliate supporters. Access to Services is provided to the Schools’ supporters (hereafter: Users) at no charge contingent upon User's acceptance of this User Agreement and the Terms and Conditions of Use herein.
TERMS AND CONDITIONS OF USE
All Users of Services, upon accessing and using Services, agree to comply with the Terms and Conditions of Use set forth herein. If you do not accept and agree to comply with the Terms and Conditions Of Use do not access and use Services.

Transactions submitted by Users for the purchase of items offered by the School create a buyer-seller relationship between the User and Schoolhouse Fare.
UNLESS OTHERWISE SPECIFICALLY PROVIDED, NOTHING DISPLAYED BY SERVICES SHALL BE CONSTRUED TO CREATE A CONTRACT FOR THE SALE OF GOODS OR SERVICES BETWEEN SCHOOLHOUSE FARE AND THE SCHOOL; OR BETWEEN SCHOOLHOUSE FARE AND ANY VENDOR OR ANY OTHER THIRD PARTY.
Performance & Security
Services are transmitted electronically over the World Wide Web and the Internet. Independent service providers beyond the control of Schoolhouse Fare form part of the worldwide Internet communications network. Electronic transmissions using the Internet cannot be guaranteed to be one hundred percent free from harm or guaranteed to perform as expected. By accessing and using Services, you acknowledge, you accept, and you agree that you use Services at your own risk, and further agree that Schoolhouse Fare shall not be liable if Services experience a security breach, if Services have malfunctions, if there is an interruption to Services, or if information is misused or mismanaged in any way to your detriment or the detriment of a third party, whether by Schoolhouse Fare (including it's Agents, Associates, or Partners), by the School with which you are affiliated, or by an unauthorized third party.

SERVICES (INCLUDING ALL GOODS AND SERVICES PROVIDED THROUGH IT) ARE PROVIDED "AS IS" WITH NO WARRANTIES WHATSOEVER. SCHOOLHOUSE FARE HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES THAT THIS PRODUCT/SERVICE IS FREE OF DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE, AND NON-INFRINGING. FURTHERMORE, TO THE EXTENT PERMITTED BY LAW, SCHOOLHOUSE FARE DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THIS SERVICE OR GOODS RECEIVED THROUGH ANY LINKS PROVIDED IN THE SERVICE, AS WELL AS FOR ANY INFORMATION OR ADVICE RECEIVED THROUGH THE SERVICE OR THROUGH ANY LINKS PROVIDED IN THE SERVICE. SCHOOLHOUSE FARE FURTHER DISCLAIMS, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY WARRANTIES FOR ANY INFORMATION OR ADVICE OBTAINED THROUGH THE SERVICE. SCHOOLHOUSE FARE FURTHER DISCLAIMS ANY RESPONSIBILITY FOR THE DELETION, FAILURE TO STORE, MISDELIVERY, OR UNTIMELY DELIVERY OF ANY INFORMATION OR MATERIAL PROCESSED THROUGH OR BY SERVICES.
Limitations Of Liability
UNDER NO CIRCUMSTANCES SHALL SCHOOLHOUSE FARE BE LIABLE TO ANY USER ON ACCOUNT OF THAT USER'S USE OR MISUSE OF AND RELIANCE ON SERVICES OR ITS ASSOCIATED PRODUCTS AND SERVICES. SUCH LIMITATION OF LIABILITY SHALL BE APPLIED TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES (EVEN IF SCHOOLHOUSE FARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON THE SERVICE, ITS PRODUCTS OR SERVICES, FROM INABILITY TO USE THE SERVICE, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICE OR DAMAGES INCURRED BY REASON OF OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THIS SERVICE OR RECEIVED THROUGH ANY LINKS PROVIDED ON THIS SERVICE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED ON THE SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE PRODUCTS AND SERVICES.
IF A LEGAL AUTHORITY EVER DECIDES OTHERWISE, SCHOOLHOUSE FARE AS WELL AS ITS ASSOCIATES, AGENTS, AND PARTNERS) SHALL HAVE NO OBLIGATON, WHATSOEVER, TO COMPENSATE THE ORHER PARTY TO THE CONTRACT FOR SUCH PARTY'S INDIRECT, CONSEQUENTIAL, PUNATIVE OR SPECIAL DAMAGES ARISING FROM SCHOOLHOUSE FARE’S BREACH OF SAID CONTRACT OR ITS NEGLIGENCE (EVEN IF SCHOOLHOUSE FARE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). FURTHERMORE, SCHOOLHOUSE FARE’S COLLECTIVE LIABILITY FOR ANY AND ALL DIRECT DAMAGES SHALL BE LIMITED TO THE TOTAL COLLECTIVE AMOUNT OF FIFTY (US $50) DOLLARS.
BY ACCESSING AND USING SERVICES, YOU ACCEPT AND AGREE THAT ANY GOODS, FOOD, AND SERVICES OR OTHER MATERIAL OBTAINED DIRECTLY OR INDIRECTLY THROUGH USE OF SCHOOLHOUSE FARE SERVICES IS PROCURED AT YOUR DISCRETION AND RISK, AND YOU FURTHER ACKNOWLEDGE AND ACCEPT SOLE RESPONSIBILITY FOR ANY DAMAGES OR LOSS THAT MAY RESULT FROM THE ACQUISITION OF SUCH GOODS, FOOD, SERVICES, OR OTHER MATERIAL.
SCHOOLHOUSE FARE CANNOT AND DOES NOT GUARANTEE THAT THE CONSUMER SHALL BE FREE FROM ALLERGIC REACTION TO ANY FOOD PROVIDED BY FOOD SUPPLIERS AND YOU SHALL BE SOLELY RESPONSIBLE FOR MONITORING, AND PROTECTING AGAINST, ANY SUCH REACTION. SCHOOLHOUSE FARE SHALL NOT BE LIABLE FOR AND EXPRESSLY DISCLAIMS ANY AND ALL DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE DAMAGES, AND OTHER TYPES OF DAMAGES IN ANY EVENT IN CONNECTION WITH ALLERGIC REACTIONS TO FOOD OR OTHER ISSUES WITH FOOD SUPPLIER PRODUCTS OR SERVICES EVEN IF SCHOOLHOUSE FARE HAS BEEN ADVISED BEFOREHAND OF ANY SUCH ALLERGIES THAT MAY EXIST.
Services have various security provisions in place to protect the integrity of the information transmitted between Users and the Subscribing Organization. For example, Users are required to establish a personal password to access Services. As a security measure, you agree not to disclose your personal password to anyone. By accessing and using Services you accept the following User Responsibilities: You agree to use Services only for the purpose for which it is intended and acknowledge that any nonconformance use of Services is prohibited; You agree not to do anything to disguise or obstruct sender information in order to distort the source of any content transmitted through the Service; You agree you will not interfere with (or attempt to) disrupt the Services or supporting networks in any manner that might directly or indirectly disrupt the normal flow of data and hinder use of Services. You agree you will not infect Services with software viruses, or any other computer code, files or programs designed to interrupt, trace, monitor, copy, destroy or limit the functionality of any computer software.
By accessing and using services, you accept to honor payment for selected, purchased, and received goods. Schoolhouse Fare accepts payment by debit or credit cards from Discover, Visa, or MasterCard. Schoolhouse Fare also accepts personal checks. If check payment is returned as insufficient funds, the account will be put on hold until payment is resolved. A fee of $20.00 will be added to the transaction to cover the fees for returned checks of insufficient fund. In the event that an account has a credit, the credit will be applied to the next order. If there isa request for a refund of the credit to the original form of payment, there shall be a 10% processing fee deducted from the available credit on the amount refunded.
All Services provided by Schoolhouse Fare are protected by copyright and trademark laws as well as international treaties. Unauthorized reproduction or distribution of Services, or any portion thereof (including operating and underlying software code, as well as system designs and constructs) may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under the law.
Users accepting the Terms and Conditions of Use set forth in this User Agreement are permitted to print or save copies of their personal account information for their personal records only. Authorized representatives of the School, who serve as program administrators, are granted access to administrative tools under a separate Confidentiality Agreement that permits authorized program administers to generate management reports and save electronic and printed copies of account information solely for the School’s administrative purposes. Any other use of Services without the explicit written consent of Schoolhouse Fare is prohibited.
Data Collection & Use
Schoolhouse Fare reserves the right at all times to monitor and disclose transactional data posted by you or any other user as necessary to satisfy any legal authority having jurisdiction over such matters, or to edit, refuse, or remove any information or materials, in whole or in part, that Schoolhouse Fare, in its sole discretion, deems to be objectionable or in violation of the Terms and Conditions of Use.
Changes to Terms and Conditions of Use
Schoolhouse Fare reserves the right to change Terms and Conditions of Use at any time, for any reason, and without notice, including the right to terminate Services. Users therefore agree to periodically review Services Terms and Conditions Of Use to remain abreast of current obligations, requirements, and/or restrictions as defined by Services Terms and Conditions Of Use.
Changes in Services
Schoolhouse Fare reserves the right to change Services provided at any time, for any reason, and without notice, including the right to terminate Services. Users therefore agree to periodically review Services Terms and Conditions Of Use to remain abreast of current obligations, requirements, and/or restrictions as defined by Services Terms and Conditions Of Use.
This Agreement shall be governed by the laws of the State of South Carolina. By using Services and agreeing to these Terms and Conditions of Use, you consent to personal jurisdiction and venue in the state and federal courts located in and serving Charleston County, South Carolina with respect to such disputes arising out of or relating to this User Agreement and the Terms and Conditions Of Use set forth therein.
If any provision of this User Agreement shall be ruled invalid or unenforceable by a court of law, all remaining provisions not dependent upon the unenforceable or invalid provision shall survive intact and remain enforceable as if the invalid provision did not exist, and to the extent permitted by law, the court shall give effect to the parties' intentions, as reflected in any such right or provision that has been declared invalid or unenforceable
This User Agreement shall benefit and be binding on the respective successors in interest, heirs, executors, administrators and assigns of Schoolhouse Fare.
Consent to Breach Not Waiver
No term or provision hereof shall be deemed waived and no breach excused, unless such waiver or consent is in writing issued by Schoolhouse Fare. Any consent by Schoolhouse Fare to, or waiver of, a breach, whether express or implied, shall not constitute a consent to, waiver of, or excuse for any different or subsequent breach.
Remedies for breach of this User Agreement are cumulative and may be exercised concurrently or separately. The exercise of any one remedy shall not be deemed an election of such remedy to the exclusion of other remedies.
The Section headings used herein are for convenience and reference purposes only and are not intended to define, limit or describe the scope or intent of any provision of this User Agreement and shall have no meaning or effect upon the interpretation of this User Agreement.
Account activity is monitored for compliance with the Terms and Conditions of Use. In the event that nonconformity is discovered, an offending User's account will be deactivated without notice at the sole discretion of Schoolhouse Fare. If after having accessed and used Services you at some future time no longer agree to comply with the Terms and Conditions of Use, you hereby agree to immediately notify Schoolhouse Fare (by email or phone) to inform Schoolhouse Fare that you no longer accept and agree to the Terms and Conditions of Use, and upon receipt of your notice your account will be immediately deactivated and your records frozen for reference at future dates for administrative or other necessary purposes.
By accepting this User Agreement and its governing Terms and Conditions of Use, you attest and affirm that you have read the Terms and Conditions of Use, that you understand them, and that you agree to be bound by these Terms and Conditions of Use. If you do not agree to the Terms and Conditions of Use regarding your use of this Service, you will not be permitted to use this Service.
